Terms of Service

By commissioning me, you confirm that you have read, understood, and fully agreed to my Terms of Service (T.O.S), which serve as a binding agreement between us.Mainly, I work with custom adopt/outfit designs, but I can also create a reference sheet for your character, design an outfit for them, etc.

General Rules:• To claim a slot, please DM me on Twitter. We can switch to Discord afterward for easier communication if preferred.• Before making a payment, please provide a complete reference sheet or a detailed description for custom work, along with all your specific requests.• Once you’ve claimed a slot, payment is required within 24 hours.• If you claim a slot but fail to pay within 24 hours or do not respond, your request will be canceled.• Work on your commission will begin within 7 days after payment. Each commission has an individual deadline starting from 30 days or more, depending on complexity. If I am unable to complete your commission within the agreed timeframe, you may request a refund, which will be processed within 72 hours.• If you claim a slot and pay for it, but become unresponsive for more than 14 days without notice, I will proceed to complete your commission based on the provided references. The final result will be delivered to you, but no further changes will be made without an additional fee.• I reserve the right to decline any commission without explanation before payment is made.

Payment and Commercial Use:• All prices are listed in USD (United States Dollars).• Payments are accepted via PayPal or Ko-Fi.• Work on your commission will begin only after full payment is received.• Commercial use (e.g., Twitch, YouTube, VTuber models, comics, books, games, etc.) is included in the base price for all types of commissions. You are free to use the commissioned design\artwork for any purpose (as long as it does not violate any other terms of my service).• For use of my artwork on merchandise (e.g., prints, clothing, stickers), a 100% fee will be added to the base price.

Work Process:• During the sketch stage, free revisions are available as follows:
— Up to two full pose changes.
— One complete clothing change.
— Up to ten minor adjustments (such as facial features, hairstyle, or specific clothing details).• After the sketch stage is approved, only minor changes are allowed:
— Small details can be added or removed, and colors can be adjusted.• Free revisions will also be provided if I make a mistake or overlook any details specified in your reference sheet.• The completion time for each commission is individual and calculated separately for each type of work. The timeframe starts from 30 days.• You will receive work-in-progress (WIP) updates at three key stages:
— Sketch.
— Line art with base colors.
— Beginning of rendering.• Once completed, the final artwork will be delivered to your email in full resolution and original quality.

Usage Policy:• I retain the intellectual property rights to all my artworks and reserve the right to use them in my portfolio or share them on social media.• If you would like your commission to remain completely confidential indefinitely, an additional fee of +100% applies. This must be communicated to me before the commission begins.• If you wish for the artwork to remain confidential for a specific period of time, no extra charge is required, but you must inform me in advance.• Proper credit must be given if you share or use my artwork publicly.• Use of my artwork for AI training, NFTs, or similar purposes is strictly prohibited.• You may only use the commissioned work for the purposes outlined in the Terms of Service (T.O.S.) or any other use explicitly agreed upon beforehand.If you violate these terms, I reserve the right to block you and refuse any future commissions.

If there are any uncertainties, please clarify it and discuss it with me in advance! I'm fully prepared to address any questions you may have.

I usually work with two days off per week - typically Saturday and Sunday (sometimes it may be other days) . During my days off I don’t reply to messages at all.On workdays, I reply to messages for about 2 hours a day, and I always check and respond within an hour after posting a new adopt.Outside of those times, I may not see your message right away - thank you for your patience and understanding!
This routine helps me protect my mental health and stay consistent in my work.

Adoptable Terms of Service

If you have any questions or uncertainties, please feel free to clarify and discuss them with me in advance. I am always open to communication and ready to address any concerns you may have.

General Rules:After Payment, You Will Receive:
• A high-resolution PNG file(s) of the artwork without a watermark.• You may resell the adopt at the same price or lower. You are also welcome to gift or trade it.
— The resale price can be higher if additional commissions have been made for the design.• You are allowed to modify the character’s colors, details, or clothing.
— If you'd like me to make these changes for you, this can be done for an additional fee.
Price of changes starting from $10• Please make sure to credit me (@hiemsmoon) whenever you post or share the artwork.• Use of the design for AI training, NFTs, or similar purposes is strictly prohibited.• You may only use the design for the purposes outlined in the Terms of Service (T.O.S.) or for any other uses mutually agreed upon in advance.If you violate the T.O.S., I reserve the right to block you and, in certain cases, you may forfeit your rights to the adopt, allowing it to be resold.

Payment and Commercial Use:• All prices are listed in USD (United States Dollars).
• Payments are accepted via PayPal or Ko-Fi.• Please be prepared to complete the payment within 24 hours after claiming the adopt.
— If payment is not received within this timeframe, the adopt will be relisted for sale.• No refunds are available.
— If a refund request is initiated through the payment service, the adopt will be resold, and you will lose all rights to the design.• Commercial use (e.g., Twitch, YouTube, VTuber models, comics, books, games, etc.) is included in the price of all my adopts. You are free to use them as you wish, as long as it does not violate any of my other rules.

Payment Plan:
Payment plan for fixed-price adopts are not available to new clients and are only offered through auctions.
Payment plans for fixed-price adopts may be available for clients I’ve worked with before, but not always. Each request is considered individually, and I may decline for various reasons. I hope for your understanding!For adopts priced at $350 or more, a standard payment plan:
• 50% upfront payment.
— Payment is made within 24 hours after the claim.
• The remaining 50% can be paid within 30 days on any date that is convenient for you.Custom payment plans (for longer periods or different payment structures) can be discussed individually.
However, please note that:
• Payment plans for amounts below $300 are not available.
• Payment plans longer than 60 days are not available.Please note that % of the initial payment is non-refundable in case you're unable to complete the second part. If any difficulties come up, I'm open to slightly extending the payment deadline. However, please understand that the first payment cannot be refunded under any circumstances. If the full payment for the adopt isn't completed within the agreed timeframe, I will retain % of the amount and the adopt will be relisted for sale.Feel free to contact me anytime if you'd like to discuss or arrange a suitable payment plan!

Reselling and Giveaways PolicyThis policy applies to all clients who purchase my designs from March 16, 2025 onward.Purchasing my designs solely for the purpose of reselling or using them in giveaways is strictly prohibited.
If your primary intent is to resell or host a giveaway immediately after purchasing, you are not permitted to buy my designs.The only exception to this rule is if you plan to create a VTuber model based on the design.
— In this case, the model must be at least partially or fully completed before it can be resold.
— However, you must contact me in advance to discuss your intentions before purchasing the design.This policy does not apply to clients who initially purchased the design for personal use but later choose to resell it due to unforeseen circumstances.
It is specifically intended to prevent design flipping or using my designs for raffles/giveaways without proper use.
